THE PROBLEM


The Kg Kelaik community in Kelantan faces a deep and ongoing injustice whereby their ancestral land—central to their identity, culture, and survival—has been severely violated through encroachment by development companies since 2009. 

 

Despite having lived on the land for generations, drawing sustenance from the surrounding resources and honouring it as sacred ground, the community’s rights were disregarded when the state and its agencies issued licenses for mining, logging, and plantation activities without the community’s free, prior, and informed consent (FPIC). These intrusions have devastated their surrounding environment, destroyed crops, polluted their only water sources, and desecrated sacred burial sites. As a result, the community’s traditional way of life—rooted in harmony with the land—has been deeply disrupted.

The government, bound by law to protect them, has instead failed in its duty, enabling dispossession and silencing the voices of a community that has always called this land home. The state’s failure to recognise and protect their customary land rights, as required under common law, the Federal Constitution, and the Orang Asli Act 1954, constitutes a breach of fiduciary duty and basic constitutional protections. In response, three Kg Kelaik residents filed a lawsuit against 10 companies and 4 government bodies in 2021. To support this crucial legal battle and raise public awareness, the campaign seeks funds for legal fees, a public awareness campaign, and logistical support during trial preparations. 

The Kelaik case is part of a broader struggle faced by most Orang Asli and Orang Asal communities across Malaysia. At its heart, this lawsuit is a plea to reclaim what was wrongfully taken—the ancestral land that has nourished and sustained the Kg Kelaik Orang Asli for centuries. 

 

THE SOLUTION


In seeking justice, the Kg Kelaik Orang Asli are calling on the court to formally recognise their native customary rights to the ancestral land they have inhabited for generations. They demand that all licenses granted to companies for mining, logging, and plantation activities be declared unlawful and revoked. The community is also calling for the Kelantan state government to fulfil its constitutional and fiduciary obligations by gazetting their land as an official Orang Asli Reserve under the Orang Asli Act 1954, ensuring long-term legal protection from future encroachment. Additionally, they are requesting the court to order full compensation for the destruction and losses they have suffered—including general damages, aggravated damages and exemplary damages—as well as injunctions to halt all ongoing commercial activities on their land immediately. 

The campaign serves as a rallying point for public support, crucial in ensuring the well-being and livelihoods of Kg Kelaik residents. Contributions to this cause directly aid the indigenous community in their fight for ancestral land rights. By engaging with this campaign, individuals stand in solidarity against the corporate exploitation that has long ignored the rights and welfare of the Orang Asli. Ultimately, this is not just a legal case—it is a collective call to restore the Kg Kelaik Orang Asli community’s dignity and right to live peacefully on lands steeped in centuries of historical and cultural significance.

 

THE IMPACT


This campaign not only secures legal representation and logistical support for the Kg Kelaik community but also contributes to broader goals. Upholding ancestral land rights through legal channels establishes a foundation of legal security, shielding the community from land grabs and arbitrary displacements. The achievement of this would foster a concrete sense of security and stability. Beyond legal victories, the campaign signifies a commitment to human rights, environmental protection, and the preservation of  cultural diversity. Ultimately, success in this case holds the potential to transform not only the immediate circumstances of Kg Kelaik but also sets a precedent for indigenous rights and environmental conservation in Malaysia.

KAMPUNG KELAIK COURT CASE UPDATES

MARCH: On March 10-12, 2025 the court heard emotional testimonies by plaintiffs Ahak bin Uda, Anjang bin Uda, and Aziz bin Angah about the destruction of their ancestral land and cultural heritage. Ahak detailed how logging and land transfers — without their Free, Prior, and Informed Consent — have devastated their farms, polluted rivers, and cut off access to traditional roaming areas. Anjang reinforced these claims with population records and customary land maps, while Aziz highlighted the loss of sacred sites and disrupted funeral traditions. 

Their testimonies were backed by a 2012 police report, input from expert anthropologist Dr. Kamal Solhaimi, and comprehensive cultural and population documentation presented by Abdul Shazni and supported by Amirah Haziqah.

The court rejected the plaintiff’s request for an in situ judicial visit to Tanah Adat Kelaik before cross-examination, which, if necessary, could only take place after the cross-examination. The visit would have allowed judges to observe the cultural, historical, and ecological significance of the land, as well as the damage inflicted on the community. 

Kampung Kelaik Village Secretary Anjang bin Uda: “I’m not sure what the court’s decision will be, but I leave it to them to decide. For now, we can only wait and see. I hope NGOs and supporters will continue to follow the hearings and bear witness to what happens next.”

The next court hearings are scheduled for June 15-16, August 26-27, and October 27-29, 2025. Civil society groups will continue to monitor the proceedings and amplify the voices of the Kelaik community.


JUNE: The continuation of the hearing for the territorial claim of customary lands of the Kg Kelaik Temiar Orang Asli took place on June 15-16, 2025

After the last plaintiff signed the witness statement, Mr. Ahak, as the first plaintiff, took the oath for a cross-examination session by the defendants’ lawyers. 
The examination began at 2.30 pm, and the court adjourned the session after two hours. 

On the second day, the defendants’ attorneys requested a postponement of the cross-examination session on the pretext of wanting to obtain a map from the Office of the Director of Land and Minerals (Defendant 11).

The Plaintiff’s attorney, Ambbi Balakrishnan, objected that the Defendant had sufficient time before this trial took place in March earlier this year.

After considering the arguments of both parties, the court adjourned with the agreement that the Defendant must file the map and statements of the Defendant's witnesses before July 31, 2025.⁣

The trial will resume on August 26-27, 2025.

SUARAM's People Before Profit (PBP)

SUARAM's "People Before Profit" Desk began as an effort to focus and coordinate the struggles of  Malaysians against profit-driven projects. Monitoring and documentation by SUARAM showcase a concerning pattern indicating that various State and Non-State actors are complicit in numerous violations of human rights under the guise of development in Malaysia. The situation on the ground has not changed much, deforestation and land grabbing of indigenous peoples' land is still happening. 

 

Civil Society Organisations (CSOs) Support Group for Kg Kelaik
On March 10th, 2021, three residents from Kampung Kelaik filed a summons against ten companies and four state government agencies of Kelantan. Since then, a few concerned organisations* have assisted them in amplifying their case.

Due to prolonged legal proceedings, in November 2023, a group of CSOs agreed to establish a Support Group for Kampung Kelaik Temiar Rights. This support group is an effort to show solidarity with the indigenous community in Kampung Kelaik and help them raise funds for their fight. The fundraising efforts will cover their legal fees, logistics during court trial days in the High Court of Kota Bharu, Kelantan, and assessments on the soil, water, and rock due to encroachment activities.
